Missing visa information in the package-travel form: withdrawal costs and damages

If a package-travel form omits passport and visa requirements, assess the information duty, withdrawal compensation and possible damages separately.

Before a traveller is bound by a package travel contract, the organiser must provide information about general passport and visa requirements for the destination. Section 4(1)(6) PRG also refers to approximate periods for obtaining visas and completing health formalities where relevant to the trip. If the standard information form omits the notice, the starting point is a breach of a pre-contractual information duty.

The information gap does not answer the withdrawal or damages question by itself. The assessment depends on the booking documents, when the information was supplied, the reason for withdrawal, the deduction claimed and a specific disadvantage that can be proved.

Create a timeline covering the booking, information, application, authority response and costs. A damages claim requires a separate review of breach, causation and loss.

What passport and visa information must be provided

Section 4(1)(6) PRG covers the general passport and visa requirements of the destination. The notice must address requirements relevant to the package travel offered. It also includes approximate periods for obtaining a visa and completing health formalities.

The information must be given clearly, intelligibly and prominently. A notice hidden in an inaccessible document may require a different assessment from a readable statement in the booking process. Section 4(5) PRG places the burden of proving compliance on the organiser and, where applicable, the travel agent.

This is general travel preparation. It does not replace an application to the competent authority or an assessment of individual requirements. Nationality, residence status, purpose of travel and the travel document may matter to the decision in a particular case. What the missing notice means for the contract

The Package Travel Act distinguishes pre-contractual information from the content of the contract that follows. Section 6(2) PRG requires the contract confirmation to reproduce the entire contract content, including the information listed in section 4(1)(1) to (8). The traveller should be able to identify what was supplied before and at the time of contracting.

Section 5(1) PRG expressly lists only the information in section 4(1)(1), (3), (4), (5) and (7) as part of the package travel contract. The visa information in number 6 is not listed there. The missing notice may therefore breach an information duty, but it does not by itself prove that the organiser promised a visa or a particular entry result.

A separate promise about assistance, a document or a specific travel condition must be assessed on its own wording. Preserve the original advertisement, standard information form, contract confirmation and messages from the booking process.

What withdrawal costs may arise despite the missing notice

Section 10(1) PRG permits withdrawal from a package travel contract at any time before the trip begins. The organiser may demand reasonable and justifiable compensation. A contractual scale must reflect the time remaining until departure, expected savings and income from other use of the travel services.

The missing notice does not automatically remove that rule. It matters whether the traveller is making an ordinary withdrawal under section 10(1) or relying on another statutory ground. If the organiser deducts an amount, request the contractual clause, the calculation and the savings taken into account.

The refund should separate payments for the package from any compensation. A schedule showing the price, instalments, withdrawal statement, receipt time, deduction and balance makes the calculation reviewable. When withdrawal without compensation is possible

Section 10(2) PRG allows withdrawal without compensation when unavoidable and extraordinary circumstances occur at or near the destination. They must significantly affect the performance of the package or the transport of travellers to the destination. In that situation, payments made for the package must be refunded in full, without an additional compensation payment.

A missing or unclear visa notice does not automatically satisfy this test. The provision is linked to conditions at the destination and their significant effect on the trip. A personal difficulty obtaining a visa may therefore require a different assessment from a general entry restriction at the destination.

Preserve the destination, travel period, official information, date of knowledge and concrete impact on the booked services. General uncertainty about entry is not necessarily enough for the statutory classification. The withdrawal statement should make the actual reason clear.

When damages caused by the information gap should be assessed

A missing notice may cause financial loss, for example if a visa application was made too late, a travel service was lost or additional processing and rebooking costs arose. Damages do not follow automatically. The assessment requires a specific duty, a provable loss and the necessary connection between them.

It must also be established what information was owed, when it should have been available and whether clear information would have prevented the loss. An authority refusal may have several causes. The file should therefore contain the authority decision, the documents submitted and the communication with the organiser.

A price reduction under section 12(1) PRG generally concerns a non-conformity in the performance of the package. It must be distinguished from loss caused by missing pre-contractual information. Do not claim the same position twice. List every expense with date, amount, reason and supporting document.

Which documents prove the information gap

Save the booking page as it appeared when the contract was made. Keep the standard information form, contract confirmation, terms, invoices and the booking email. For a telephone contract, record what was said and request the documents on a durable medium.

Add all communications about visas, passports and health formalities. Preserve messages with sender, recipient, date and time. If the information changed after booking, document that later development separately from the information available when the contract was concluded.

How to prepare withdrawal and damages separately

First state whether you are withdrawing, requesting missing information or claiming a loss. These statements pursue different objectives. For withdrawal, identify the contract, scheduled departure and time the statement reached the recipient.

If compensation is deducted, request a transparent calculation. If information was missing, ask which notice was supplied before the contract and where it can be found. For damages, assign every amount to the event and its document.

A legal assessment can review the information duty, the ground for withdrawal, the claimed compensation and the specific loss together. Prepare the full booking file, communications with the organiser, authority messages and payment records.

Key point: Section 4(1)(6) PRG requires relevant package-travel information about general passport and visa requirements and approximate periods. An omission may breach an information duty.
