When conditions at a destination deteriorate substantially before a package trip begins, travellers face a precise question: can they withdraw without a compensation charge and recover all payments? Section 10 of the Austrian Package Travel Act does not apply to every personal concern or every general uncertainty. It requires extraordinary and unavoidable circumstances at the destination or its immediate vicinity that substantially affect the performance of the trip or the transport to the destination. This article explains how to assess the event, the contract, the evidence and the refund.

Why the travel product and timing matter first

Section 10 PRG concerns withdrawal from a package travel contract before the package begins. Package travel generally combines at least two different types of travel service for the same trip, such as transport and accommodation. Whether the Act applies depends on the actual booking process, not merely on the heading of an offer. The package travel and tour operator overview explains the wider structure.

Timing matters just as much. This article addresses a withdrawal made before the package starts. A problem during the trip may instead raise questions about notice, assistance, a price reduction or termination because of a significant lack of conformity. The cancellation of a single return flight is not automatically a section 10 PRG case. Depending on the booking, air passenger rights or package travel rules may apply.

Keep the booking confirmation, pre-contract information, invoice, payment records and the booked services. If several businesses are involved, identify the tour operator and the travel agent. The package travel check helps structure the booking, but it cannot alone determine whether extraordinary circumstances exist.

What extraordinary and unavoidable circumstances mean

Extraordinary and unavoidable circumstances do not exist merely because a trip has become unpleasant, uncertain or economically unattractive. The concept concerns a situation beyond the control of the party relying on it, whose consequences could not have been avoided even if all reasonable precautions had been taken. This definition is reflected in Article 3(12) of Directive (EU) 2015/2302 and in the Austrian PRG.

Relevant situations may include a serious security risk, a natural disaster or a substantial health risk. Naming an event is not enough. There must be a reliable connection with the particular destination or its immediate vicinity. A general report about a distant region therefore says less than current information that matches the booked place and period.

The question of inevitability also requires attention to the circumstances. It may matter whether the event was already known when the booking was made, how specific the warning is and whether the effects concern the booked services. When the trip is substantially affected

Section 10 PRG requires a substantial effect on the performance of the package or on transport to the destination. This is more than a minor inconvenience. The relevant question is not simply whether something has happened, but whether the concrete trip can still be performed in a materially different or unsafe way under the actual conditions.

Location, period, intensity and duration may all matter. So may the route, accommodation, planned activities and transport. The same event can affect a round trip differently from a stay in one location. A broad headline or social-media post cannot replace a comparison with the booked itinerary.

For a health risk, official recommendations, access restrictions, medical care and the actual spread may be relevant. For a natural event, closures, damage to transport routes or access to the accommodation may matter. Record which information supports the conclusion and for which period it applies. A later improvement can change the assessment.

Which evidence matters for the withdrawal

Prepare a short chronology. Record the booking and payment, the departure date, the event, official warnings, communication with the operator and your withdrawal notice. Save documents in the form received and note date and time. For websites and customer accounts, PDF exports or screenshots with the URL and retrieval time can help.

Depending on the case, evidence may include official travel information, security notices, natural-hazard information, border or airport closure notices and statements from local authorities. The volume of material is less important than its relevance to the booked destination and period. Do not treat an unverified message as an established fact.

The operator’s response also belongs in the file. Keep emails, messages, call notes, proposed alternatives and proof of receipt. If an alternative trip or rebooking is offered, record its content and price without accepting it prematurely. Your notice should clearly show whether you are withdrawing under section 10 PRG or merely requesting a voluntary solution.

How to make the withdrawal clear

Send the withdrawal to the tour operator through a channel that can be proven. State the booking number, travellers, destination, departure date and affected services. Briefly describe the event and expressly state that, because of extraordinary and unavoidable circumstances, you withdraw from the package travel contract before departure under section 10 PRG without a compensation charge.

Do not mix withdrawal, a request for rebooking and a goodwill request in one unclear message. If you want to examine an alternative only as a fallback, say so separately. Send the notice to the operator named in the documents. If a travel agent handled the booking, it can also be sensible to submit the message there and document receipt at both points.

The operator does not have to accept your legal assessment for your notice to be clear. What matters is that its content and receipt can be shown. Keep the sent version, attachments and technical confirmation. If the operator disputes the withdrawal, the substantial impact must be assessed against the concrete facts.

Keep the refund and travel insurance separate

If section 10 PRG applies, no compensation charge is payable for that withdrawal. Payments made for the package must be refunded in full. A voucher does not have to replace a money refund unless an appropriate agreement is made. Keep proof of payment and the operator’s calculation separately.

The statutory withdrawal right is distinct from travel insurance. Cancellation insurance may cover personal reasons such as illness under the policy. It is not the legal basis for section 10 PRG. Conversely, an event at the destination may raise both a statutory and an insurance question. Do not accept unsupported processing or cancellation deductions from a refund. If individual services were booked outside the package, assess those contracts separately. A hotel booking, hire car or stand-alone flight does not automatically follow the PRG refund mechanism. The booking file should connect every service and payment to its contract party.

Which situations are not section 10 PRG cases

Personal illness, work commitments or family reasons may make a cancellation understandable. For the free withdrawal under section 10 PRG, however, the destination or its immediate vicinity must be affected by circumstances that substantially impair the particular trip or transport. Personal reasons should therefore first be checked against the contract and travel insurance.

An operator insolvency, a transfer of the contract or a later amendment to a travel service requires a different assessment. A substantial pre-departure change may fall under section 9 PRG. Insolvency raises questions about the statutory protection and the correct contact point. These situations should not be combined because their facts and legal consequences differ.

Finally, pre-departure withdrawal is different from a travel defect during the trip. If an agreed service is not provided as promised, notice, assistance, price reduction and damages may become relevant. The withdrawal glossary entry helps with the basic distinction.

Prepare a reliable assessment in seven steps

Start with the confirmation, terms, invoice, payment records and all destination information. Mark the departure and return dates. Then describe the event by place, period, source and concrete effect on the booked services.

Compare the information with the actual itinerary. Which transport, accommodation and activities are affected? Is the impact substantial or is it only general uncertainty? What was known when the booking was made and what changed afterwards?

Make the withdrawal clear and preserve proof of receipt. Request a full refund and list separate contracts separately. If the operator refuses, prepare the chronology, destination evidence, booking records and correspondence for the next assessment. The first consultation checklist helps organise the file.
