A hotel room must be usable and hygienically reasonable for the agreed stay. If guests discover bedbugs, cockroaches, suspicious traces or another pest infestation on arrival, they should not only notify reception. They should also preserve the condition of the room immediately.

Whether a replacement room is sufficient, a reduction of the accommodation price is possible or further costs can be recovered depends on the booking and the response of the business. The time of discovery, the seriousness of the defect, the remedy offered and the actual loss all matter.

Connect every expense to the actual sequence of events.

Sort invoices by accommodation, transport and other expense. Add the date, reason and communication with the hotel. An expense is not recoverable merely because it is high.

At arrival: Avoid changing the condition before photographing and reporting it where possible. If a room change is necessary for hygiene reasons, record the observations first and ask the business to confirm the change and its time.

What a pest infestation means for the hotel contract

A confirmed room booking requires the business to provide the agreed accommodation in a condition suitable for the stay. Pest traces can substantially interfere with that use. The first question is not whether the business already knows the cause. It is which deviation existed and whether the room could still be used safely and hygienically.

Under section 918 ABGB, a paid service that is not performed at the agreed time, place or in the agreed manner can trigger contractual responses. A hotel stay usually requires a quick practical solution. A precise notice of the defect and a reasonable remedy therefore normally come before a later monetary claim.

The label used in the conversation is not decisive. Whether the parties speak of pests, bedbugs or contamination must be assessed against the actual condition and its effects. One insect alone does not automatically prove a widespread infestation. Photos, witnesses and the business response help make the seriousness understandable.

How guests should record the defect immediately

Photograph the affected area from close range and also photograph the room as a whole. Useful images may show the bed, mattress, skirting boards, walls, furniture and any traces. Keep the original files. A later edited message is not a substitute for the original record.

Note the date, time, room number and the person to whom you reported the issue. Write down briefly what you saw yourself. Fellow travellers or other guests may also be relevant witnesses. If there are bites or health complaints, keep medical records in a separate document group.

Preserve the booking confirmation, room description, offer photographs, house rules, messages and invoice. If a member of staff inspects the room or offers a move, record the conversation immediately afterwards. A neutral timeline is usually more useful than a general account of frustration.

When a replacement room is a reasonable remedy

A replacement room does not have to be identical. It must replace the promised service in a way that fits the purpose of the stay and the circumstances of arrival. Compare the category, size, bed, bathroom, facilities, location, accessibility, meals and remaining period.

A room in another building may create additional travel. A substantially lower category can reduce the value of the booking. Location can matter on a business trip. For a family, the number and arrangement of beds may be decisive. These factors do not automatically produce a particular amount, but they should be considered when assessing the remedy and a possible reduction.

Guests should not accept an offer only orally without a record. If a move is necessary because of hygiene, accepting it to limit further loss may be sensible. When leaving or booking another hotel may be justified

If no hygienically reasonable replacement is available, continued use of the original room may be unreasonable. The decision to leave should not happen without a record. State why the offered room was insufficient or why no remedy was available. Record the time of departure and the search for a suitable alternative.

Where possible, look for another hotel in a comparable category and location. In an acute situation the search should not force anyone to remain in a room that creates a health concern. Still preserve available alternatives, prices and communication with the original business. This helps assess whether the expense was necessary and reasonable.

Rejecting a reasonable replacement without a clear reason can later raise questions about mitigation. On the other hand, no guest has to accept a hygienically unsafe solution. Section 1304 ABGB requires a person’s contribution to the loss to be taken into account. Reasonableness depends on the condition, urgency and alternatives actually offered.

How a price reduction differs from further costs

A price reduction concerns the value of the accommodation that was not provided or was provided only in part. It is different from additional expenditure. If a lower replacement room is offered, the difference between the booked and received value may matter. If another hotel is booked, it is also necessary to examine payments already made and the new expense caused by the defect.

Depending on the sequence, relevant positions may include replacement accommodation, reasonable transport or an advance payment for a service that could no longer be used. No general percentage can be applied reliably. Duration, intensity and actual effect are decisive. Credits or costs already covered by the hotel must also be included in the calculation.

Section 1295 ABGB links damages to a culpable loss. Contractual deviation, fault, loss and causation should therefore be shown separately. The hotel invoice alone does not prove the claim. For each position provide the amount, proof of payment, reason and time connection. Package travel is subject to additional rules under the Austrian Package Travel Act.

What the accommodation business should document

The business should record the guest’s notice with time, room, contact person and substance. It should then document the condition, its own inspection and immediate measures. This may include closing the room, contacting a specialist and checking adjoining rooms.

A replacement offer should state the address, room category, facilities, meals, transfer and who bears the cost. If cleaning or treatment is promised, record timing and scope. A short internal note that no infestation was found is not a substitute for documenting the original condition and the inspection carried out.

The business should bring the booking, room status, cleaning records, notices and communications together. Blaming the guest too quickly makes a factual assessment harder. A broad goodwill promise without stating which item it resolves creates a similar problem. Clear records protect both sides and support a later settlement.

Common mistakes when pest traces are discovered

A frequent mistake is photographing only the visible trace. Without room number, overview images, time and booking records, it may remain unclear where and when the trace was found. Evidence should connect the specific stay with the condition of the room.

Delayed notice is another problem. Raising the issue only after departure makes inspection and cause assessment more difficult. Immediate notice does not automatically establish a claim, but it gives the business a fair opportunity to remedy the situation and preserve evidence.

Finally, guests and businesses often mix a price reduction with damages. A repayment for accommodation that was not provided has a different function from reimbursement of necessary transport or additional hotel costs. Each item should therefore be named and supported separately.
