Hotel stars are a specific quality and orientation statement in a booking offer. A business using a star number should be able to prove the current classification status, its scope and the version of the advertising used. Under section 2 UWG, an incorrect or misleading presentation can be problematic if it is capable of influencing a guest’s commercial decision.

The complete presentation matters. Star symbols, wording such as “4-star hotel”, images, search results, room offers and booking platforms can together create an impression of a particular standard. The Austrian hotel classification must be distinguished from a state operating permit. A classification therefore does not answer every question about permission to operate or the actual condition of a particular room.

This article explains which records belong with a star statement, how to separate a test rating from an official classification and which steps are useful after a challenge. What section 2 UWG asks of hotel star statements

Section 2(1) UWG covers commercial practices containing incorrect statements or otherwise capable of deceiving market participants about essential product characteristics. In a hotel offer, the star statement can be part of the information from which guests infer equipment, service and quality. The relevant question is how the statement reaches the public, not only what the operator intended internally.

The advertising must also be capable of influencing a commercial decision. That can include choosing a hotel, booking a particular room or deciding to pay a higher price. A completed booking is not necessarily required for the legal assessment of the advertising statement.

An unclear or late explanation can affect the assessment as well. A notice hidden in a difficult-to-find submenu does not automatically explain a prominent star number. The main statement, additional information and booking route must present a coherent picture to guests.

Which records prove the classification status

The official information on the Austrian hotel classification describes a process involving an application, questionnaire, on-site assessment, classification and written notification. After the classification is completed, the business receives a certificate and a sign or sticker, with the certificate stating the validity of the classification. These records provide the practical basis for controlled star advertising.

Keep the current certificate, star number, exact property name and validity period together. The application, result of the on-site assessment and criteria version used should also remain traceable. After a change of operator, corporate name or offer, check whether the record still concerns the same property and the same presentation.

A digital test classification or internal self-assessment serves a different purpose. It can support preparation, but it does not by itself prove an officially awarded star number. The two levels must remain separate in public communication. Otherwise a preparation tool can create the impression of a valid award.

What hotel stars say and what they do not replace

Hotelstars Union describes a common European classification system with a criteria catalogue and an on-site audit. The areas assessed include general hotel information, reception and services, rooms, food and beverages, leisure facilities and quality and online activities. The classification places the property in a category whose criteria were assessed at the relevant inspection.

Hotel stars therefore provide orientation about classified quality and equipment. They are not a blanket promise that every room always has every feature. Booking statements about room size, accessibility, catering, location or specific additional services must remain correct and current independently of the star number.

Stars are also not a state operating permit and are not a general proof of hygiene, environmental performance or compliance with every individual legal duty. Those statements require separate checks. When stars, sustainability labels and official permits appear in one design element, their meanings should remain visibly distinct.

How to handle validity, downgrades and category changes

The classification is time-limited. The official Hotelstars Union information states that classifications are reviewed regularly. The WKO describes the Austrian process as having a validity of three to six years. Advertising therefore depends on the current status, not on a star number that was awarded in the past.

After a downgrade, withdrawal or closure, the affected signs and texts must be reviewed promptly. The WKO points out that after a downgrade the new category must be used, or the hotel stars must no longer be used. This concerns the sign at the property as well as the website, platform profiles, brochures, social media and distribution partners.

Assign responsibility and a review date for changes. Also check cached platform profiles, PDF brochures and image files in which a star number is fixed. Correcting the home page is not enough if a guest still sees an outdated category through another booking route.

Why every booking route needs the same star number

The star statement should match the classification proof in every advertising medium. This includes the page title, home page, room detail pages, price boxes, structured data, newsletters, search profiles and booking platforms. The business should record where the number appears and who triggers an update.

Check the specific wording as well. “4-star hotel” has a different effect from a clearly identified example. Wording such as “4-star comfort” or “4-star feeling” can also create expectations about a category when it appears near a booking without a clear explanation. The WKO recommends avoiding such wording without official classification.

An explanation should be available where the star number influences the choice. It should clearly relate the status, property and, where relevant, validity. A later explanation in the legal notice or a general information page may come too late for the booking impulse itself.

Which checks help before publishing the advertising

Start with a list of all star statements. Search the website, booking platforms, PDF material, social media and image assets for the star number and for descriptions such as “Superior”, “premium class” or “star comfort”. Assign the intended audience and booking route to each location.

Compare every location with the certificate, validity period, property name and category. Check whether a room page adds statements that go beyond the classification. Proof of the property category does not replace checking the room description or individual performance promises.

Record the approval with date, version and responsible person. After changes to the classification, operator, building or offer, review the star advertising again. The overview on handling cancellation requests transparently illustrates the value of organised records, but the star review remains a separate task.

What matters after a hotel star advertising challenge

Preserve the challenged version immediately. Save the URL, screenshots, date, booking flow, displayed star number, logos and communication with the platform. Record whether the statement was visible on one channel or throughout the public presentation.

Place the current certificate and earlier classification records beside it. Check the property name, category and validity period. If a platform imports the statement automatically, also record when the business supplied the information or requested a change.

Changing the text may end the visible error, but it does not automatically answer every further legal question. Check separately whether guests have already booked, whether distribution partners continue to use the number and which version of the advertising was accessible. An initial legal assessment therefore needs the advertising record, classification proof and specific challenge together.
